British National (Overseas) visa

The UK Government have now opened the British National (Overseas) visa, which allows a person from Hong Kong to come and live in the UK. Both them and their family members are now able to apply for the visa. This is being called a BNO Visa. It would allow them to come and live in the UK without any restrictions on their visas. 

The requirements of the BNO Visa

As part of the visa application, you will need to meet certain requirements to support the application, which includes demonstrating you hold British national (overseas) nationality. You must 18 years of age or older at the date of application and Hong Kong must be your permanent home.

How long is the BNO Visa granted

Once the visa is granted, you will be granted either 30 months or 5 years residency in the UK. You will be able to extend your visa if you want to stay longer. You can apply to extend your visa as many times as you want.

Can you apply for indefinite leave to remain under BNO Visa

Where you have completed 5 years of residency in the UK, you can apply for indefinite leave to remain. In order to apply for ILR, you will be required to demonstrate that you have met the following key requirements:

  1. You meet the KoLL requirements, including English language requirements.
  2. Pass the life in the UK test. 
  3. Have spent no more than 180 days outside the UK in any 12 months in the last 5 years.
  4. You must also prove that you have completed the 5 years residency requirements. 

Applying for British nationality

British Nationality laws set out by the 1988 Act, requires a person of good character and meet the residency requirements. An application must be lodged for consideration.
