{"id":161,"date":"2013-10-26T14:28:21","date_gmt":"2013-10-26T20:28:21","guid":{"rendered":"http:\/\/www.icslegal.com\/blog\/?p=161"},"modified":"2016-10-27T09:32:49","modified_gmt":"2016-10-27T15:32:49","slug":"consideration-of-the-right-to-respect-for-family","status":"publish","type":"post","link":"https:\/\/icslegal.com\/blog\/consideration-of-the-right-to-respect-for-family\/","title":{"rendered":"Consideration of the right to respect for family and\/or private life"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div><p>A valid application is not required where an Article 8 claim is raised:<\/p>\n<p>\uf0b7 as part of an asylum claim, or as part of a further submission in person after an asylum claim has been refused; or<br \/>\n\uf0b7 where a migrant is in immigration detention; or<br \/>\n\uf0b7 where removal directions have been set pending an imminent removal; or<br \/>\n\uf0b7 in an appeal; or<br \/>\n\uf0b7 in response to a (one-stop) notice issued under section 120 of the Nationality, Immigration and Asylum Act 2002.<\/p>\n<p><span style=\"font-size: 13px; line-height: 19px;\">Where, under paragraph GEN.1.9, Article 8 is being considered in any of the\u00a0<\/span>circumstances specified above, the applicant is only eligible for consideration under the 10-year partner or parent route.
