ILR under Judicial Review

You can apply for indefinite leave to remain under the judicial review if you have been in the UK for 4 years as a highly skilled migrant.

The Immigration Rules at paragraphs 245G of part 6A, and Appendix A, B and C, explains the requirements to be eligible to extend under the Tier 1 general category.

The points-based assessment

To apply under Tier 1 (General), you must pass a points-based assessment. You must score:

1.    75 or 80 points for your attributes (age, qualifications, previous earnings, and experience in the UK); and

2.    10 points for your English language skills; and

3.    10 points for available maintenance (funds).

If you do not score enough points, your application will be refused. You should read all the information in this section before you apply. You must pay the correct application fee when you apply, and send the correct supporting evidence to support your application. If your application is unsuccessful because you do not meet the requirements, Home Office will not refund your fee.
