Indefinite Leave to Remain under Judicial Review

You can apply for indefinite leave to remain under the judicial review if you have been in the UK for 4 years as a highly skilled migrant.

As a Tier 1 Migrant, when you extend your stay in the United Kingdom and have been successfully granted leave to remain, then the following conditions applies to and your dependant:

1.        you have no recourse to public funds (which means you will be unable to claim most benefits paid by the state); 

2.        you have been given entry clearance, or leave to enter or remain as a highly skilled migrant or as a post-graduate doctor or dentist; 

3.        you were previously given entry clearance or leave to remain as a highly skilled migrant and that was not subject to a condition prohibiting employment as a doctor in training.
